J Properties III, LLC (“Company,” “we,” “us,” or “our”), a Florida limited liability company, owns and operates the website at historicdowntownapartmentsjax.com (the “Site”) for our Elena Flats apartment community in Jacksonville, Florida. We respect your privacy and are committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights you have.
By using the Site or submitting information to us — including through our contact, maintenance request, or rental pre-screening forms — you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site or submit information to us.
1. Information We Collect
Information you provide directly.
We collect the personal information you choose to give us when you interact with the Site or our leasing office, including:
- Contact and inquiry details — your name, email address, phone number, and the contents of any message you send through our contact form or by email.
- Rental pre-screening and application information — information submitted through our pre-screening questionnaire or rental application, which may include your name, contact information, current and prior addresses, employment and income information, rental history, number of occupants, pets, desired move-in date, and similar information used to evaluate a tenancy.
- Maintenance request information — your name, unit, contact information, and a description of the maintenance issue when you submit a maintenance request.
- Other communications — any information you provide when you call, email, or otherwise communicate with us about leasing, a showing, or your residency.
Information collected automatically.
When you visit the Site, we and our service providers may automatically collect certain technical information through cookies and similar technologies, such as your IP address, browser type, device type, operating system, pages viewed, referring/exit pages, and the dates and times of your visits. This helps us operate, secure, and improve the Site.
Sensitive information. As part of the rental application process, our screening partners may collect information such as a Social Security number or government identification in order to verify identity and perform credit and background checks. Where a third-party screening provider collects this information directly, its handling is governed by that provider’s own privacy practices.
2. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and provide leasing information or schedule showings;
- Process and evaluate rental pre-screening questionnaires and applications, including identity verification and credit, background, and rental-history screening;
- Receive, route, and respond to maintenance requests;
- Administer leases and the landlord–tenant relationship;
- Operate, maintain, secure, and improve the Site and our services;
- Send administrative or transactional messages, and, where permitted, information about our properties;
- Comply with applicable laws, including fair housing and recordkeeping requirements, and enforce our agreements; and
- Detect, prevent, and address fraud, security issues, and other harmful activity.
3. How We Share Your Information
We do not sell your personal information for money. We may share your information in the following circumstances:
- Service providers. With vendors who perform services on our behalf — such as tenant-screening and background-check companies, website hosting and analytics providers, payment processors, and communications tools — who are authorized to use the information only to provide those services.
- Property management and affiliates. With our property managers, leasing brokers, and affiliated entities involved in operating the community.
- Legal and safety. When required by law, subpoena, or legal process, or when we believe disclosure is necessary to protect our rights, property, or safety, or that of our residents or others.
- Business transfers. In connection with a sale, financing, merger, or transfer of all or part of our business or assets, including the property.
- With your consent. For any other purpose disclosed to you at the time you provide the information, or with your direction or consent.
4. Cookies and Tracking Technologies
The Site uses cookies and similar technologies to function properly, remember your preferences, and understand how visitors use the Site. Most web browsers let you refuse or delete cookies through their settings; however, disabling cookies may affect how parts of the Site work. We do not currently respond to browser “Do Not Track” signals.
5. Third-Party Links
The Site may contain links to third-party websites or resources, such as HUD.gov or our screening and application partners. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any site you visit.
6. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
7. Data Retention
We retain personal information for as long as needed to fulfill the purposes described in this Policy, including to provide our services, evaluate applications, administer leases, and comply with our legal, tax, accounting, and fair-housing recordkeeping obligations. When information is no longer needed, we take reasonable steps to delete or de-identify it.
8. Your Choices and Rights
You may contact us at any time using the information in the “Contact Us” section below to:
- Request access to, correction of, or deletion of personal information we hold about you;

Florida residents: The Florida Digital Bill of Rights and other applicable laws may provide certain rights regarding your personal information. We will honor applicable rights and respond to verifiable requests as required by law. Because some rights apply only to businesses meeting specific thresholds, the rights available to you may vary. We will not discriminate against you for exercising any rights you have.
9. Children’s Privacy
The Site is intended for adults seeking rental housing and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can delete it.
